• Taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure
• Uploading invalid data, viruses, worms, or other software agents through our Services
• Using our Services for any commercial purpose without our prior written consent
• Impersonating another person or otherwise misrepresenting your affiliation with a person or entity
• Violating any applicable law or regulation

4. Intellectual Property Rights

4.1 Our Content

The Services and their original content, features, and functionality are and will remain the exclusive property of LightStridesMareketing and its licensors. The Services are protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

4.2 User Content

You may be permitted to post, upload, publish, submit, or transmit content through our Services ("User Content"). By making available any User Content through our Services, you grant to LightStridesMareketing a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, and otherwise exploit such User Content only on, through, or by means of our Services.

5. Educational Services

5.1 Program Registration

Registration for our educational programs is subject to availability and acceptance. We reserve the right to refuse registration to any individual at our discretion.

5.2 Fees and Payment

Registration fees for our educational programs are as stated on our website or in our promotional materials. All fees are quoted in Canadian dollars and are subject to applicable taxes. Payment must be made in accordance with the payment terms specified during registration.

5.3 Cancellation and Refunds

Our cancellation and refund policy for educational programs is as follows:

• Cancellations made more than 14 days before the program start date will receive a full refund minus a $50 administrative fee.
• Cancellations made between 7-14 days before the program start date will receive a 50% refund.
• No refunds will be issued for cancellations made less than 7 days before the program start date.
• LightStridesMareketing reserves the right to cancel or reschedule programs due to low enrollment or other circumstances. In such cases, registrants will be offered the option to transfer to another program or receive a full refund.

6. Links to Third-Party Websites

Our Services may contain links to third-party websites or services that are not owned or controlled by LightStridesMareketing. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that LightStridesMareketing shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

7. Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LightStridesMareketing EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LightStridesMareketing MAKES NO WARRANTY THAT (I) OUR SERVICES WILL MEET YOUR REQUIREMENTS, (II) OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF OUR SERVICES WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LightStridesMareketing, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, OUR SERVICES.

IN NO EVENT WILL LightStridesMareketing'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO LightStridesMareketing FOR THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100).

THE LIMITATIONS OF THIS SECTION WILL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT LightStridesMareketing HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to defend, indemnify, and hold harmless LightStridesMareketing, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services, including, but not limited to, your User Content, any use of our Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from our Services.

10. Governing Law and Jurisdiction

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or our Services shall be instituted exclusively in the courts of the Province of British Columbia located in the city of Vancouver, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by any court or other competent authority, such provision shall be modified to the minimum extent necessary to make it legal, valid, and enforceable, and the other provisions shall remain in full force and effect.

12. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or a waiver of any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
